NON-CERTIFIED TERRORISM ENDORSEMENT & SUPPLEMENT CHANGES APPROVED
Reference Bulletin 03-0162

The non-certified terrorism endorsement and manual supplement changes described in Reference Bulletin 03-0162 have been approved in Minnesota with an effective date of July 1, 2003.

BACKGROUND

On May 2, 2003, in Reference Bulletin 03-0162, we indicated that terrorism exclusion endorsements and manual supplement pages that do not contain a fire exception had been filed in response to the enactment of House File 267. Although replacement of the applicable portions of both our certified and non-certified terrorism materials were made, in accordance with the "File-and-Use" provisions of the Terrorism Risk Insurance Act of 2002, companies were reminded to limit their July 1, 2003 implementation to only the certified materials, until notice of the insurance department's approval of the non-certified terrorism materials was provided by AAIS. This bulletin is being issued to advise companies that insurance department approval of the non-certified terrorism materials has now been received, and that such materials may be implemented accordingly, effective July 1, 2003.

CHANGES

During the course of the review of our filing, a change to our manual supplement which had not been anticipated in Reference Bulletin 03-0162, and which is unrelated to standard fire policy provisions, was required. Specifically, the insurance department asked that the multistate Interstate Accounts rule shown on manual supplement page Rules -- 8 be replaced with a state-specific version of this rule. A copy of the amended rule is included in the manual supplement attached to this bulletin.

Endorsements and Rules

Under Minnesota Rules Part 2700.2470, companies that have granted AAIS filing authority for forms and/or manual rules for a line of insurance can adopt the filing referenced in this bulletin without notifying the insurance department. Companies that choose not to adopt the filing, to deviate from the approved filing, or that choose a different effective date must make an internal (drawer) filing.

Farmowners and Farm Properties only

Endorsements and Rules

Companies that have granted AAIS filing authority for forms and/or manual rules for a line of insurance can adopt the filing referenced in this bulletin without notifying the insurance department. Companies that choose not to adopt the filing, to deviate from the approved filing, or that choose a different effective date must notify the Insurance Department in writing before the effective date designated by AAIS.
