AVAILABILITY REPORT

The AAIS war and terrorism exclusions have been further revised in order to address concerns regarding language interpretation and to ensure that the AAIS endorsements will be acceptable in all states that have agreed to accept the NAIC-sanctioned language. Per Bulletin 02-0075, the latest endorsements eliminate any question as to whether coverage provided under the AAIS war and terrorism terms is equivalent to that provided under the NAIC-sanctioned language. Endorsements CL 0468 01 02 with "No Fire Exception" and CL 0469 01 02 with a "Fire Exception" are compatible for use with the traditional non-filed Inland Marine classes (AAIS Inland Marine Guide). 

AAIS will make advisory filings for the revised War, Military Action, and Terrorism Exclusions in the states of Nebraska, Oregon, and Texas for the non-filed Inland Marine classes currently on file. AAIS is not currently pursuing the approval of a terrorism exclusion in California, Florida, and New York. 

AAIS recommends waiting until approval of the War, Military Action, and Terrorism Exclusions endorsement submitted for the Commercial Inland Marine Program (filed classes) before implementing the same endorsement for the traditional non-filed classes in states where there is no filing requirement or before filing in those additional states, where required. 

For your convenience, the states that require filing for the traditional non-filed inland marine classes are listed below under Company Action.

AVAILABLE FOR USE
When the revised War, Military Action, and Terrorism Exclusions Endorsement filed for use with the Commercial Inland Marine Program (CIM) has received state approval, AAIS will indicate that it is available for use in that state with the Inland Marine Guide on this report. Expedited filing requirements for War, Military Action, and Terrorism exclusions, if applicable, will be provided for those states where filing is required for the non-filed inland marine classes. 

  • After the state name, a footnote (1) indicates that the terrorism exclusion makes no exception for loss caused by fire. Footnote (2) indicates that the terrorism exclusion does make an exception for loss caused by fire. 

  • An "A" in the availability column of this status report indicates that the Commercial Inland Marine (CIM) Program (filed classes) War, Military Action, and Terrorism Exclusions filing has been approved in that state and is now available for use or filing for the Inland Marine Guide

  • A "Yes" or "No" in the Filing Required field indicates whether or not a filing is required for non-filed inland marine classes in that state. 

  • Under Special State Requirements/ Comments, state specific requirements will be provided. 

Most states have indicated that approval of terrorism exclusions will be granted only to the extent that the exclusions will 'sunset' or be withdrawn shortly after a federal mechanism is established to provide reinsurance for loss caused by acts of terrorism. This "conditional approval" will likely also apply to an independent filing of the War, Military Action and Terrorism Exclusions Endorsement.

COMPANY ACTION
For those states where filing is not a requirement for non-filed Inland Marine classes, War, Military Action, and Terrorism Exclusions can be implemented as soon as allowed taking into consideration state notification requirements as respects a reduction in coverage. 

In the event of loss caused by terrorism, coverage under any policy to which a 12 01 edition War and Terrorism Exclusions endorsement had been attached should be interpreted according to the terms of corresponding 01 02 edition of the same endorsement. 

The states that require filing for the traditional non-filed inland marine classes are listed below. If you have already filed the 12 01 editions in one or more states, AAIS recommends that you file the 01 02 editions to replace the 12 01 editions.

EXPEDITED FILING - COMMERICAL LINES TERRORIST EXCLUSIONS APPLICATION

Where required, companies must also include a completed Expedited Filing - Commercial Lines Terrorist Exclusions Application (Exp Filing Application) in their filings. When completing the application, companies should indicate that the endorsement(s) provide coverage that is at least as broad as the ISO endorsement(s). While a model application was developed by the NAIC, many states have customized the application to meet their specific state requirements. Refer to the Special State Requirements/Comments column for details.

On the basis of Ins §1855.5, the Commissioner has determined that rating organization filings for terrorism exclusions will be disapproved as unfair or unreasonable.
