HISTORIC PRESERVATION
TAX CREDIT COVERAGE
INTRODUCED IN BUILDERS' RISK

A new endorsement for insuring loss of historic preservation tax credits has been introduced, along with a corresponding schedule, in the Builders' Risk section of the AAIS Inland Marine Guide.

The endorsement covers the cost, up to specified limits, incurred by an insured when tax benefits for the preservation of historic properties are reduced or lost entirely due to a loss covered under the AAIS Builders' Risk Rehabilitation and Renovation form.

The endorsement provides two coverages:

  • The "Delay in Receiving Tax Credit" coverage pays for a loss arising from a postponement or interruption in an insured's ability to claim a federal, state, or local tax credit for preserving a historic property.

  • The "Loss of Tax Credit" coverage pays for a loss arising from a reduction or complete loss of a federal, state, or local tax credit for preserving a historic property.

NORTHEASTERN STATES ISSUE
DISASTER-RELATED DIRECTIVES

By design or coincidence, several states affected by the recent severe snowfalls in the Northeast have issued directives related to insurer responses to catastrophes.

  • A bulletin from the Rhode Island Department of Business Regulation revises a procedure for notifying the department regarding the temporary licensing of loss adjusters on an emergency basis.

  • A bulletin from the New Jersey Department of Banking and Insurance asks certain property/casualty insurers to describe what aspects of a catastrophe plan or disaster response preparation plan they implemented in response to the recent "Nor'easter" that struck the state. The directive applies to admitted carriers writing $20 million or more in net direct written premium for property coverage in the state.

  • The Maryland Insurance Administration recently finalized its regulation establishing a protocol for insurers when imposing a moratorium on writing policies due to a weather event.
