EXHIBITS AVAILABLE FROM 
'SECTION 111' WEB SEMINARS

Insurers can access exhibits from two recent web seminars about complying with a new federal mandate for reporting certain liability claims. The exhibits for those presentations can be accessed from a web page AAIS has created to provide information on Section 111 reporting to its member companies.

Under Section 111 of the 2007 Medicare, Medicaid, and SCHIP Extension Act, liability insurers and other entities are required to report all payments made for bodily injury and "med pay" claims to persons enrolled in Medicare.

AAIS recently arranged for two providers of Section 111 consulting and solutions--Perr & Knight and Crowe Paradis--to make presentations for AAIS companies.

AAIS programs affected by the liability claim reporting mandate are:

  • Personal Lines: Boatowners, Dwelling Properties (Landlord's Package only), Homeowners, Mobile-Homeowners, Personal & Premises Liability, and Personal Umbrella

  • Commercial Lines: Artisans, Businessowners, Commercial Liability, and Commercial Umbrella

  • Farm & Ag Lines: Agricultural General Liability, Farmowners, and Farm Umbrella

WAREHOUSE LEGAL LIABILITY COVERAGE
FEATURED IN MAY EDITION OF FC&S

The May 2009 edition of the monthly FC&S update includes a review and analysis of the Warehouse Operators Legal Liability Coverage section of the AAIS Inland Marine Guide. FC&S, a service of The National Underwriter Co., provides regular analyses of standardized property/casualty coverage forms, including those developed by AAIS.

The Inland Marine Guide is a leading resource of policy forms, rating procedures, underwriting guidelines, and other information for the traditionally nonfiled classes of inland marine insurance. The Warehouse Operators Legal Liability Coverage section provides a base form, nine endorsements, and six coverage schedules for insuring warehouse operators' liability for property of others they store.

AAISdirect 'SHOPPING CART' FEATURE
NOW EXTENDED TO INLAND MARINE GUIDE

Companies that use the AAIS Inland Marine Guide and the AAISdirect Internet service now have use of AAISdirect's "shopping cart" feature.

Similar to what is offered by online retail services, users of the Guide and AAISdirect can add Microsoft Word or PDF documents to the download cart in groups or one at a time. The items will remain in the cart while the user browses other parts of AAISdirect, moves to other websites, or even logs off AAISdirect. When the user returns to AAISdirect, the contents of the cart will still be there.

WIND/HAIL DEDUCTIBLE ENDORSEMENT
FILED UNDER MOBILE-HOMEOWNERS PROGRAM

AAIS recently initiated countrywide filing of a new endorsement for applying a separate deductible for windstorm and hail losses covered under policies based on the AAIS Mobile-Homeowners (MHO) Program.

The endorsement is filed to support a new wind/hail deductible rule filed as part of MHO program enhancements described in a previous Advisory.


MISSISSIPPI IMPOSES RESTRICTIONS
ON CERTIFICATES OF INSURANCE

A recent regulation from the Mississippi Department of Insurance, effective immediately, prohibits insurers or producers from issuing any binder, certificate of insurance, indemnity agreement, or similar instrument that expands or restricts coverage under the referenced policies.

In addition, the regulation requires insurers to file on a prior-approval basis any certificates other than the standardized certificates currently approved by the department. Each certificate filed for approval must contain language stating that it neither affirmatively nor negatively alters the coverage provided under the reference policy.

Also, binders, certificates, indemnity agreements, and similar instruments cannot make reference to contractual arrangements or insurance requirements for the purpose of defining or altering coverage.

The 2009 program lineup includes:

  • Re Claims: Reinsurance Claims Management, September 24-25; and

  • Re Finance: The ABCs of Financial Reporting & Analysis for Property/Casualty Insurers and Reinsurers, October 7-8.

All of these events are scheduled to be held in New York City.
