A new law in Alabama, effective Sept. 1, 2015, allows insurers to deliver insurance notices and documents by electronic means, provided they have obtained "affirmative consent" to electronic delivery from the intended recipients. Under the act, electronic delivery also entails the posting of documents online, along with an email notice of such postings to affected parties.
Numerous states have enacted measures allowing the electronic transmission and/or posting of insurance documents. One of the unique provisions of the Alabama law is that an insurance policy cannot be denied legal effect solely because of one's failure to obtain a party's electronic consent or confirmation of consent.
